摘要
本文针对如何进一步转变政府职能、规范教育行政行为、努力促进教育事业发展问题,分析现阶段教育行政部门在依法行政过程中所存在的"不知"、"不愿"、"不能"、"不敢"等问题,同时结合工作实践从法理角度对教育行政行为作了分析,并总结了上海市教育行政部门以推进行政执法责任制为抓手,逐步规范教育行政行为的有益探索与取得的实践经验。
Focusing on how to further change the government functions, regulate educational administrative actions and accelerate the development of educational cause, this article analyzed the problems of “being unknown, unwilling, unable and fearsome” at different levels, which educational administrative departments have encountered during the process of executing the law. Based on continuous probe and practice, it also suggests in details the methods of classifying educational administrative actions from the legal principle and sums up the practical experience in regulating progressively educational administrative actions through the system of administrative law enforcement responsibility introduced by the Shanghai educational administrative department.
