Ethical Paradox and Legal Consideration of the Informed Decision without Consent

通过回顾发生在北京某医院孕妇因其代理人不同意手术而致死的案例,分析了患方"知情不同意"的原因及医院面临的伦理及法律问题,提出了解决问题的思路:完善相关法律,建立司法救济渠道及循证建立解决"知情同意"权和生命权对立时的路径及指南。

To review a case of death of pregnant women due to the agent＇s disagreement with the cesarean section for term birth in the hospital in Beijing. From this case, we explored the reasons for the failure to obtain informed consent from the agents. We also discussed the ethical and legal issues that hospital faces, and proposed the solutions, which included maturation of the justice, development of judicial remedies, and formulation of an operational path when the rights to life is contradictory to the informed consent.
