摘要
《劳动合同法》在适用范围方面较之于《劳动法》:一是扩大了适用主体的范围,二是将非典型劳动关系及事实劳动关系等纳入调整的范畴。劳动合同法对适用范围的界定,直接牵涉到我国劳动人事管理体制改革的大局,关系到不同主体的利益及其保护,必然在立法过程中经历反复的论证和博弈,同时在实施过程中需要加以全面理解、具体诠释和对立法精神的探究。
