国际法视野下人民币汇率合法性的探讨

On the Legitimacy of the RMB Exchange Rate from International Law Perspective

近年来,以美国为首的资本主义国家一直在指责我国人民币汇率过低,甚至以采取贸易报复相要挟,要求我国政府提高人民币汇率。文章从我国现行人民币汇率机制的特点入手,在结合国家货币主权理论和《国际货币基金协定》相关规定基础上得出我国人民币汇率政策完全符合《国际货币基金协定》中的要求,美国等国指责中国政府操纵人民币汇率的主张是缺失理论依据的结论。

In recent years, the US - led capitalist countries have accused the low RMB exchange rate , even threatening to take retaliatory trade and requiring the Chinese government to increase the RMB exchange rate. This paper starts with China＇ s current RMB exchange rate mechanism and the characteristics, in conjunction with the state＇ s theory and monetary sovereignty and＂ IMF agreement＂, builds the basis of the relevant provisions of China＇ s RMB exchange rate policy entirely consistent with＂ IMF agreement＂. The author argues that Amerca＇ s accusation of China＇ s menipulation of RMB exchange rate is lack of theoratical basis.
