The Survival Condition of the Customary Laws of China's Minority Nationalities

少数民族习惯法发挥作用的鼎盛时期在中华人民共和国和成立前。后来,随着民族地区社会的变迁和国家法制建设不断完善,民族习惯法已经逐步被国家制定法所取代,丧失了以前的强大功能。我们在实地调查的基础上,对民族习惯法的历史状态,当前存在的形式、发挥的作用,社会各界对民族习惯法的态度,以及民族习惯法的未来进行了分析和研究。企图揭示民族习惯法在国家制定法的强大压力下的生存状态及前景。

The heyday when the customary laws of China＇s minority nationalities functioned best was before the founding of the People＇s Republic of China. With the social changes and the perfection of the legal system in the minority areas, such customary laws have been gradually substituted by the national laws. Based on fieldwork, this paper discusses the history, the present situation, the functions, the attitudes of the people at different levels and the prospects of such customary laws, especially the survival condition under the great pressure of the national laws.
