摘要
刑法功能的发挥取决于两个方面,一是刑法的精确性、明晰性和具体性的程度;二是刑法调控范围的程度。在当前生态环境需要刑法保护的情况下,完善刑法的功能实属必然趋势。刑法需要重构生态环境刑事立法价值,体现生态环境的重要地位,采取有效的措施与方法,完善刑法的生态环境功能。
The functions of the criminal law find expression in two aspects： 1. its accuracy, clarification and practicability; 2. the scope of its adjustment and control. At present, the eco-environmental value calls for the protection of the criminal law, which in turn calls for the perfection of the functions of the criminal law. The legislation of the criminal law needs the eco-environmental value as one foundation. Thus, it is necessary to adopt efficient measures to perfect the eco-environmental functions of the criminal law.
