摘要
国外对无被害人犯罪的立法沿革呈现非犯罪化的趋势,但刑法典中仍保留了许多无被害人犯罪罪名。而我国刑法对无被害人犯罪一直持以谨慎的态度,更多地是作为行政处罚的范畴和道德领域的事。对此,本文对中西无被害人犯罪刑事立法政策作了深入的比较研究,并从"犯罪分层"、宗教与伦理、国家权力观几个方面对导致中西政策差异的原因作了透析,从中找到借鉴的价值与可行性。
The western legislative evolution concerning victimless crimes shows the tendency of decriminalization, yet even such accusations are reserved in the penal codes. The situation is different in China, where criminal law is cautious towards victimless crimes and administrative sanction and moral condemnation are resorted to. This paper explores the criminal legislation policies concerning victimless crimes between China and western countries and shows their differences from three aspects, namely, criminal stratification, religion and ethics, and the sense of state power. Hopefully this study can reveal something significant for relevant research.
