在刑事附带民事诉讼中确立精神损失赔偿制度的思考

Reflections on Establishing the Psychological Compensations System in Civil Proceedings Attached to Criminal Cases

目前,虽然可以在民事诉讼中提出精神损失赔偿,但在侵权程度更严重的刑事案件中,并不能把精神损害赔偿纳入刑事诉讼范围中,随着人民物质生活水平的不断提高,精神生活也日益受到人们的重视,因此,笔者建议今年修改刑诉法中,在刑事附带民事诉讼活动中建立精神损害赔偿制度。

Although psychological compensations can be waged in civil proceedings, they are not regarded as part of criminal proceedings in the cases of serious tort. This paper proposes that the psychological compensations system be established in civil proceedings attached to criminal cases in accordance with social development.
