论经济法的最高价值——经济效益

On the Highest Value of Economic Law-the Economic Efficiency

经济法的价值是经济法哲学的核心。文章从经济法的产生背景,经济效益是经济法应有之义,经济法治通过经济立法、经济执法、经济司法、经济守法四位一体的良性运作来实现经济效益,经济效益与经济法治的其他价值如经济民主、经济秩序、经济公平的关系等几个方面阐述了经济效益是经济法治的最高价值的观点,这对于推进依法治国建设社会主义法治国家具有一定的参考价值。

This paper elaborated that the economic efficiency was the highest value of the economical government by law. from the background of economic law, it thinks economic efficiency was indispensable with economic law, which is realized by integrated operation of the four factors： economical legislation, economical law enforcement, economical judicature, and economical observance; the relationship between economic efficiency and some other value of the econolical govemment by law, such as economical democracy, economical order and economical fairness to some extent, would provide some academic value reference for advancing the govemment by law and the construction of a socialist country under the rule of law.
