摘要
《物权法》将土地承包经营权确定为用益物权,还将"土地承包经营权"纳入《物权法》中的"用益物权"编并单独成一章居于该编之首,这充分证明"土地承包经营权"的重要法律地位。《物权法》第十一章"土地承包经营权"内容,就整体而言主要依据《农村土地承包法》而架构,对家庭承包取得的用益物权性质进行法律规范,与2003年3月1日生效的《农村土地承包法》相衔接,使法律规范具有一贯性。《物权法》颁布,将为土地承包经营权法律制度的实施和完善奠定坚实基础。
Land contract for the managerial right in Property Rights La will be identified as usufruct rights in rem,and it will be made into a separate chapter and put it first part of the usufruct rights in rem.This fully proves the land contract for the managerial right important legal status.land contract for the managerial righ in Chapter 11 of Property Rights La is based primarily on 'Rural Land Contract Law',standards the usufruct nature by the household contract,and has an convergence with the 'Rural Land Contract Law' entered into force on March 1,2003.consistent legal norms.The promulgation of Property Rights La will lay a solid foundation for the implementation and improvement of the land contract for the managerial righ legal system.
