A Legal-anthropological Approach to Non-governmental Legal Order

摘要民间法秩序是地方民众围绕着财富分配所形成的总体性的竞争与合作秩序。作为"总体社会事实"的民间法秩序,其实更多地是一种理解地方社会的视角,不是经验层面所有社会现象的简单叠加。而解读民间法秩序,可能会遇到纠纷的发生学机制、通过走进"他者"的精神世界来阅读法意识、民间法秩序中的国家因素等几个层面的方法论问题。 Nongovernmental legal order is overall competitive and cooperative order that the local people distribute wealth. Actually, as total social fact, nongovernmental legal order is a visual angle of comprehending local society. There are some methodology questions to comprehend nongovernmental legal order, such as genetic organism of dispute, understanding legal idea and the state factors of nongovernmental legal order.
