浅议委托作品

On Commissioned Composition

委托作品在现实中是关系复杂的作品。我国现行法律对它的权属问题的规定不明确、不具体,法学界的解释也具较大的随意性。包括委托作品在内的著作权立法,既要借鉴国外著作权法普遍接受的基本原则,又必须顾及我国的基本国情。立足我国委托作品著作权保护的立法现状,借鉴国外相关立法经验,委托作品的著作权保护立法,可以"独立合同说"为基本取向。

In practical fact, commissioned compositions are involved with complicated relationships. Effective Chinese laws haven＇ t yet pinpointed the issues in relation to authorship and rights concerning commissioned works. Legislation concerning the authorship that involves with the commissioned works should not only borrow for reference from the principles well established in copyright laws of foreign countries, but also take into account the practical circumstances in our country. With respect to the current circumstances of law-making and pertinent referencing to legislative experiences from foreign countries, legislation system in relation to commissioned composition can orient to the “theory of independent contract”.
