关于建立我国缺陷产品召回法律制度的思考

Thoughts on the Construction of the Legal System of Recalling Defective Goods

缺陷产品召回制度于上个世纪六七十年代肇始于美国,今在发达国家已非常完善,而我国缺陷产品召回制度的立法却刚刚起步。故应借鉴发达国家的立法经验及实践经验,并结合我国国情,构建我国缺陷产品召回的法律制度。以此引导企业在市场竞争中健康发展,保护消费者的人身财产安全。

The legal system of recalling defective goods originated in American during 1960s and 1970s. Nowadays, the system in the developed countries is ahnost perfect. In China, the legislation about it is just at the very beginning. Chinese legal system of recalling defective goods should be improved by learning from the practical experience and the legislative experience of the developed countries according to Chinese real situation. By doing so it could lead the enterprises develop healthily in the market competition and guarantee the safety of person and property.
