专利制度对技术创新的激励作用——法经济学视角的分析

Promotion Effects of Patent System on Technological Innovations—— an analysis of law and economics

专利制度的本质是通过市场垄断来激励创新和鼓励技术扩散的一种制度安排,但市场垄断降低资源配置的效率,从社会福利角度看,应对专利制度的利弊进行权衡。本文从"不保护论"的理论依据入手进行分析,指出专利制度的垄断效应导致的效率损失并不足以阻却对技术创新的激励。

The nature of patent system is a regulation arrangement that promotes innovation and transfer of technology by means of market monopoly; at the same time, however, the market monopoly power reduces the efficiency of allocation of resources. From the viewpoint of social welfare, we should balance the benefit and cost of patent system. This paper, on the basis of the theory of ＂ Non - Protection＂, points out that the efficiency lost resulted from monopoly power of patent system is too far to offset the promotion effect on technological innovation.
