Legal Countermeasures for Short-Term Labor Contracts Trend

摘要 当前,劳动合同短期化现象普遍存在,而且愈演愈烈,引起了社会的广泛关注。劳动合同短期化的现状,如果得不到合理的限制,不仅会严重损害劳动者的合法权益,影响用人单位特别是企业的长远发展,也会造成劳动关系和社会秩序的不稳定。针对这一问题,可以采取以下法律对策:(1)限制短期劳动合同的签订次数;(2)加大终止劳动合同的成本;(3)突出无固定期限劳动合同的地位;(4)明确工会在劳动合同制度中的作用。 At present, short- term contracts trend is a common phenomenon and becoming fiercer, which arouses the widespread social interest. If it cannot be limited logically, it will do harm to the legal right of the labors, ildluence the long - term development of the company and also bring unsteady status to the labor relation and social order. According to the problems above, we may take the following legal countermeasures: ( 1 ) limit times of the short - term labor contract; (2) increase the cost of termination labor contract; ( 3 ) prominent non - fixed deadline labor contract status; (4) exert the function of labor union in the labor contract, make clear trade union' s function in work contract system.
