论刑事诉讼财产异议制度之建构——以刑事侦查阶段之财产权保护为视角

On the Structure of Property Objection in Criminal Procedure——Viewed from the Property Protection in the Criminal Investigation Stage

由于刑事诉讼中国家权力与被追诉人财产权利存在冲突,因此刑事诉讼中的诸多措施极易侵犯被追诉人的财产权利。借鉴民法和民事诉讼中关于财产权保护的相关制度,通过有选择的改造,从实体权利构建和程序制度保障两方面,建构刑事诉讼中的财产异议制度,以期对被追诉人之财产权起到切实的保护作用。

By occasion of the conflicts between national power and suspects＂ property rights in criminal procedure, many measures may easily infringe the property rights, Lessons from the relevant principles and regimes of property rights protection from civil law and civil procedure law, and from two aspects which are substantive rights and procedure systems to construct the system of property objection in criminal procedure in the hope of protecting the suspects＇ property rights firmly.
