摘要
旧城更新中,政府对土地进行了频繁调控,而与此同时地价、房价持续飙升,呈现调控与失效相伴的局面,剖析其原因,土地产权制度变迁是滋生问题的历史根源,而计划与市场的交织导致了双轨配置制度下的土地交易困境。地方政府对土地的绝对垄断扭曲了土地竞争市场,而这又源于城市土地产权制度本身的残缺。解决问题的关键在于创新城市土地制度,即基于明晰旧城土地产权关系的前提,政府退出非公共利益的土地交易市场,实现政府角色的转换,以此确保旧城更新中房地产业的健康发展。
In the process of old city renovation, the government made frequent adjustment on land causing increase of land price as well as apartment price. This reflects the coexistence of adjustment and its invalidity. The paper argues the problem's origin is the land property right transition. The interweaving of governmental plan and market force results in land transaction dilemma. Monopoly of local government on land, which originates from the incompleteness of land property right, distorts the land market. The key to this problem property right. The government shall recede from the development. s to create a new land institution which is based on clear land and market to realize the healthy development of real estate development.
