藏族习惯法如何适应社会主义法制建设的思考——从藏族习惯法中的“赔命价、赔血价”谈起

Thoughts on Tibetan's Common Law's Adjustment to Socialist Legal Construction ——Beginning from "Compensation for the Life Price,Compensation for the Blood Price "in Tibetan's Common Law

藏族法律文化跟其他文化一样,既有精华也有糟粕,其精华无疑是我们应该继承和发扬的。对于其糟粕,要对其加以法制化,使其能与社会主义法制体系相统一,从而为民族的安定团结、国家的繁荣昌盛、和谐社会的构建再造根基。本文对藏族传统的刑事法律中的"赔命价、赔血价"作了深入探讨,进而提出建议,希望能对民族区域自治法的完善和社会主义法制建设以及构建社会主义和谐社会有所裨益。

Tibetan's legal culture has both quintessence and dross just the same as other cultures,its quintessence is undoubtedly what we should inherit and develop.As to its dross,we should legalize it,enable it to unify with the socialist legal system,thus contributing to the national stability and unity,thriving,prosperity and harmony.This paper discussed the 'compensation for the life price','compensation for the blood price' in the criminal law,and then proposed some suggestions,hoping to offer some benefits for the national area legal construction and the construction of the harmonious society.
