关于国际投资法律问题的思考

Reflection on the International Investment Law

改革开放以来,中国已初步建立了一套以宪法为基础,以外商投资企业法为核心,结合相关国内法组成的法律体系,为我国在引进和利用外资方面提供了有力的法律保障。但随着外商投资在我国的不断发展变化,我国的外资法存在着不少的缺陷,学术界大都提出要对外资法进行完善和重构。

Since opening and reform ,China has developed a law system with the constitution as basis,foreign investment law as core and other corresponding laws offering power protection on the foreign investment. However, with the development of the foreign capital employment in China, the weak points of the law have shown up. It is suggested by the academic field to perfect the current law on foreign investment.
