By using the special construction and properties of nonconforming five degree rectangular element, the unilateral problem approximation is studied.The error estimates are given under the reasonable assumptions of regularity of the solution of the problem. The conclusions of this paper are also valid for the well known nonconforming C R triangular linear element.
