我国监护法立法模式探究

On Legislation Mode of Guardianship System in China

近现代各国民法的发展进程表明,亲权与监护制度在外延和内涵上逐渐接近,呈现互补与融合之趋势。我国在制定民法典的过程中,应根据这一趋势,科学合理地设计我国监护法的立法体例,采用"大监护"的立法模式,以不断完善我国的未成年人监护制度。

The development of civil laws in modern and contemporary countries shows the connotation and extension of paternity and guardianship develop with a tendency of mutual benefit and integration. Therefore, in the course of making Civil Code of China, we should rationally adjust the legislation of guardianship system and adopt the legislation mode of extended guardianship to perfect the guardianship system for minors in China.
