摘要
对于在同一房屋既存在房屋共有人又存在房屋承租人,双方都享有优先购买权的情况下,如何解决双方的权利冲突?目前没有明确的法律规定。笔者试图通过分析房屋优先购买权的性质和法律特征,提出解决该权利冲突的基本规则。
On condition that there exist a part owner and a leaseholder for the same house, and therefore both of them have the house preemption, how to solve the right conflict of the two sides? There is no definite legal regulation about it at present. This article tries to put forward the fundamental for solving this conflict through the analysis of the features and legal characteristics of the house preemption.
