近代时期是中国历史上数千年的民族不平等的法律制度解体崩溃、民族平等法律制度孕育的重要变革时期。这一时期的立法,对少数民族的权利及其保障不仅有原则的规定,而且具体内容都有专门规定。表现出时代性、规范性、系统性等特点。历史并辨证的对这一问题进行系统阐述,对于客观评价新中国少数民族权利保障的制度和现状,探讨当前和今后我国少数民族权利保障制度的新途径、新机制,不断完善中国少数民族权利保障,都是必要而有意义的。
