摘要
工会法对实质正义的追求是广大劳动者基本权利的根本保障。我国现行的工会法对工会立场的设定,对工会法律关系主体权利义务的配置,对工会法有效实施的强制性赋予等方面存在着诸多问题和缺陷,不能满足其社会法属性的要求。
Trade union law fails into social legislation, which pursues essential fairness and ensures the majority of employees' basic rights. Unfortunately, the trade union law of China has been formulated unscientifically and can't adequately meet the requirements of social interests and essential fairness, whether in the general idea, organizing systerns, rights and duties or legal liability.
