限期治理制度是我国环境法律体系中规定的一项基本的"末端控制"制度,在很多环境污染控制单行法和地方性环境保护法规中都有明确规定。该制度在治理与控制环境污染中发挥过重要作用,但时至今日已经异化成为了超标排污的"护身符",这是因为限期治理制度本身存在着多种缺陷。我们可以分析该制度在决定权规定上的混乱、制度适用程序上的漏洞以及保障该制度实现的法律责任上的软弱等缺陷,来检视限期治理制度在当下控制与治理污染中的绩效,进而反思其是否有存在的必要。

Deadline governance system is one kind of＂ terminal control systems＂ of China＇s environmental legal system. That system is clearly defined in many single pollution control law and local environmental legislation. The system played an important role in the governance and control of environmental pollution. But now, the system has become the standard sewage alienation ＂protective shield＂, this is because the deadline for the system of governance it- self in a variety of defects. We can study the system exist in the following defects： the decision provides the confusion, procedural loopholes in the system and the legal responsibility to protect the system is weakness, then inspect deadline governance system＇s role, and then reflect on whether it is a necessary？
