摘要
本文从专利丛林问题入手,分析了专利池的事后效率和事前效率。在此基础上,我们研究了美国和欧盟的专利池反垄断规制实践,并就知识产权法和反垄断法之间的关系进行了比较分析。最后,我们总结了衡量专利池效率的相关因素,并给出了一个反垄断规制的基本框架。
In this paper, beginning with the thicket problem of patents, we analyze ex-post and ante-post efficiency of patent pools. Based on this, we study the antitrust regulation practices about patent pools in the USA and EC. We also conduct a comparative analysis on the relationship between the law of intellectual property rights and antitrust law. At last, we sum up relative factors on which how we can measure the efficiency of patent pools, and provide a elementary framework for antitrust regulation on patent pools.
