韩国民事执行机关的设置采取的是二元制结构,执行官只涉及实施问题的民事案件的执行,执行法院的执行工作主要由司法补佐官负责,法官对于司法补佐官的执行行为的妥当性做出判断,监督司法补佐官和执行官的执行工作。韩国的民事执行机关的设置遵循着审判与执行相分离的原则,民事执行机关既不隶属于司法机关,也不隶属于行政机关,执行的实施遵循职权主义原则,体现了国家公权力的强制性和权威性,执行人员的任免程序规范,选任条件严格。

The ROK adopts a dual system in its establishment of civil execution organizations. As an independent executive organ,a marshal is responsible for executing civil cases. Execution work of the law court is under the charge of a judicial assistor. A judge passes a judgement on the properness of a judical assistor＇s s execution and supervises the judicial assistor and the marshal＇s s execution work. The establishment also adheres to the principle that adjudication is separated from execution. The civil execution organization is subordinate neither to the judicial body nor to the administrative body, and its execution follows the doctrine of function and power and embodies the enforceability and authoritativeness of the State＇ s public right. Its executive personnel＇s appointment and removal conform to the laws and regulations and they are strictly selected.
