On the Theoretical Foundation of the Substitutive Measure of Detention

确立羁押替代性措施,必须以其理论基础为依据。其理论基础主要在于三个方面:一是确立羁押替代性措施的三项原则,即无罪推定原则、比例性原则、司法审查原则;二是羁押属于例外的程序性保障措施;三是羁押替代性措施的确立必须依附刑事诉讼的目的。

Studying the substitutive measure of detention must begin with its theoretical foundation. There are three facts ： 1. the three principles of the presumption of innocence, proportion and judicial review ; 2. the detention should be regarded as an exception of abnormal procedural state ; 3. the substitutive measure of detention must be in accordance with the purpose of criminal process.
