反思法学考试制度——以法学教育目的为视角

Reconsideration about the Present Law Exam System——an angle for the purpose of law education

基于对法律职业教育和法学学术教育的综合思考,我们认为,现有的法学考试制度难以保障法学教育目的的实现,为合理改善该制度,既需要扩大选择题与案例题在试卷中的比重,也需要引入结构化面试,还需要健全法学考试规则。

This paper starts from the purpose of law education and reconsiders the present law exam system in China. According to the law vocational education and the law academical education, we hold that it is hard for the present law exam system to ensure the achievement to the purpose of law education. In order to improve this system, we should enlarge the proportion of the chosen quetions and the case questions in a paper, draw into a structural oral quiz, and perfect the law exam rules.
