污染致渔业经济损失赔偿程序初探

The preliminary discussion on reparations procedure of fisheries loss caused by pollution

作者根据我国不同类型渔业环境污染造成的经济损失，结合日本对赤潮污染及油污损害造成的经济损失赔偿的经验，建议我国有关部门组建一个由国家、地方、个人按一定比例筹集资金的渔业污染损失赔偿基金会。其赔偿程序为：遭受损失者通过当地渔政部门向该基金会提出申请，经有关部门审查核实后由基金会发放赔偿金和清理费。

Based on fisheries loss by the pollution in the different kind of fishery environment in our country, and the experiences which Japan paid the economic loss caused by red plankton bloom and the oil pollution the author suggests to set up a fisheries pollution loss reparations fund with the fund raised by the government, local and individul according to the proportion. The reparations procedures are follows: the loser applies to the fund through local fishey administration, then the reparations and the clean fee will be paid after checking by concerned departments.
