和谐社会的建构离不开礼与法——以儒家为考察中心 被引量:1

摘要 儒家所说的"礼",一般指的是社会等级制度的社会规范和道德规范,"礼"所体现的精神主旨是"德";"法"主要指的是律令或刑法,与"刑"意义相近。儒家坚信,社会的和谐离不开"礼"与"法",二者共同对社会起着重要的规范作用。在和谐社会的建构中,儒家所坚持的原则是:(1)礼法并施,德刑兼顾;(2)礼先法后,德主刑辅;(3)以礼入法,德刑统一。 Li discussed by Confucianism refers to the social norm and the ethics of the hierarchical social structure and its presented spiritual aim is virtue; law refers to orders and rules and criminal laws, which is as same as the meaning of punishment. Confucian believes the fact of being unable to build the harmonious society without Li and law, and both play a vital norm role in the society. The Confucianism principle sin building the harmonious society are : ( 1 ) action with Li and law and consideration on both virtue and punishment; (2) law after Li and, virtue first and penalty second; (3) law involving Li and unity of virtue and punishment.
