加强立法是遏制商业贿赂在我国蔓延的最重要的手段之一。我国现行反商业贿赂采取的是分别立法模式,制定单行的《反商业贿赂法》和制定统一的《反贪污贿赂法》是反商业贿赂立法的备选模式。近期应当完善现行立法,待时机成熟时制定统一的《反贪污贿赂法》,制定单行的《反商业贿赂法》不是最佳选项。
