高等教育收费对象的法理思考

Pondering from Philosophical Jurisprudence over the Parties of Higher Educational Tuition

现行的高校缴费上学制度事实上是将大学生的家长作为主要收费对象,这种制度设计不符合我国民事法律的相关规定和法理原则,既加重了家长的负担,也淡化了成年大学生的义务意识。本文从法理上分析了现行高校收费制度的不合理方面,并探讨了一条以国家助学贷款为主要收费来源、以大学生本人为主要收费对象,同时高校、社会及国家提供适当帮助的新思路。

The current tuition system of higher education aims, in fact, mainly at college students＇ parents, which goes against the regulations of civil laws concerned and the philosophical jurisprudence. As for its negative effects, this system not only makes the parents＇ burden heavier, but lighten the adult students＇ sense of responsibility. In this paper, the author analyzes the illogical aspects in the existing system of higher educational tuition from Philosophical Jurisprudence,and tries to find a new way to solve this problem. According to the author, national assistance loan for college students should become the main resource of higher educational expenditure, and the college students ought to be the major persons who afford tuition. Besides, colleges, society and our state should give university students a hand.
