对中国司法独立问题的思考

On the Judicial Independence in China

党的十七大报告关于司法体制改革的提法为"司法独立在中国"的问题提供了一个新的思考空间。本文依据党的十七大精神,从实证层面将司法独立与下一阶段的政治体制改革的可能走向联系起来进行探讨,以便为进一步推进我国的司法体制改革提供借鉴。

The Report to the 17th National Congress of the CPC mentioned the idea of reforming the judicial system, which has provided a new way of thinking for the issue of the judicial independence in China. Based on the spirit of the 17th National Congress of the CPC, this paper tries to discuss the issue of the judicial independence in China in practice, in relation to the coming reform of the political system so as to forward the reform of Chinese judicial system.
