摘要
通过案例分析和文献调查,对新西兰橄榄球协会的纪律处罚程序公正问题进行研究;对其《纪律听证规则》产生的背景、适用范围、听证程序、证据负担、处罚、申诉程序、律师的参与、独立性、受害者、费用、速度、司法审查等进行了分析,为我国体育组织纪律处罚程序建设提供借鉴。
This study conducts the research on the fairness of the process of discipline procedure in New Zealand Rugby Football Union by means of case study and literature review. The background, application, hearing procedure, proof burden, punishment, appeal procedure,legal presentation, independence, victims, expenses, speed,judicial review for ＂Rules of Disciplinary Hearings＂ are analyzed in order to provide references for the construction of sports discipline procedure of China＇s sports organizations.
