和谐是法律的上限道德理念,其内涵具有层次性,即和谐首先是道德化的利益关系,其次是自由的秩序,最后是客观化的交往范型。根据和谐的道德内涵,和谐社会应是指一种自由的社会秩序、道德化的社会关系和理想化的社会形态等诸种因素的有机体。在和谐社会语境下,刑事司法主体应该基于和谐精神和内涵转变司法观念,以期达到促进社会和谐之目的。并且,应从司法独立和增强法官素质的角度保障刑事司法观念的顺利转变。

Harmony is the legally moral philosophy ,its meaning being layered.The first is the interest relation of morality.The Second is the free order.The final is the objective exchange paradigm. According to the moral connotation of harmony.the harmonious society should be organ- isms ,which refers to a liberal social order,the social relations of morality and idealized social form. In the context of a harmonious society,based on the principal and the spirit of harmony, the criminal justice concepts should be changed,to achieve the purpose of promoting social harmony.h is doubtless to protect the perSpectiVe of the criminal justice concepts smooth transition through the independence of the Judiciary and the increase of the judge quality.
