刑事未成年被害人保护探析

A probe into the protection for adolescent victims in criminal cases

未成年人成为刑事被害人的现象日益严重,但实践中对未成年被害人的保护却不尽如人意,从而使得未成年被害人的保护变得非常现实和迫切。未成年人的生理和心理特点决定应该采取不同于一般被害人的保护制度,有必要在预防和司法实践中针对未成年人的特殊情况设置一系列独特的制度以切实保护未成年人的合法权益。

Adolescents are increasingly becoming the victims in criminal cases; however, the protection for adolescent victims is far from being satisfactory, thus making the protection for adolescent victims a realistic and crucial problem to solve. In view of adolescent victims＇ physical and psychological features, a new protecting system which is different from that for ordinary victims should be adopted. Furthermore, it is necessary to establish a new series of regulations in order to practically protect the legal rights of adolescent victims according to the specific condition of adolescents in the preventive and judicative practice.
