摘要
建设项目用地预审的作用,在目的层面,预审旨在理顺人与土地的关系;在用地管理层面,预审制度可以变被动管理为主动管理、可以有力地促进规划的实施、可以促进存量土地的使用和供地方式的改革;在社会经济发展层面,预审是实现土地宏观调控、促进土地可持续利用的有效手段。建设项目用地预审应遵循依法、规划控制、强制与审请、实质审查、公益利益和准入等六项原则。
The paper introduces the functions of prequalification, which aims at straightening out the relations between man and land. It points out that prequalification system not only can change pas- sive into active management,but also can effectively promote the implementation of the planning,as well as promote the use of rem- nant land and the reform of land supply way.In terms of social eco- nomic development,prequalification is an effective means for achie- ving macro-control of land and promoting sustainable use of land. The paper offers some principles that should be abided by:to be followed in accordance with the law,planning control,enforce- ment,substance investigation,public interests,and access.
