将国家尊重和保障人权写入宪法,是中国民主宪政和政治文明建设的一件大事,是中国人权事业发展的重要里程碑,但孤立无援的实体权利没有相应法律程序的支撑,只能是纸上谈兵。结合国外立宪经验,将必要的程序性规定写入宪法,给人权以最高程序之保障,是今后宪法修改不应忽视的重要内容。

Stipulating the national respect and human rights safeguard in the Constitution is a great invent in China demoeratie ＇eonstitutionalism and politieal eivilization eonstruetion, and also the important landmark during the development of China＇s human rights eareer. However, it is only the idle theorizing if there is no relevant juristie procedure to sustain the otherwise isolated substantive rights. With the foreign experienee on eonstitutionalism, stipulating the necessary procedural regulations in the Constitution to guarantee the human rights with the topmost proeedure will be the important eontent whieh shouldnt be ignored in the future eonstitution amendment.
