摘要 研究目的:分析美国土地开发权制度的经验,探索以经济手段改变经济利益动机影响相关人的行为,为中国土地管理和开发提供经验和借鉴。研究方法:制度经济学分析和文献分析法。研究成果:基于经济激励机制TDRs比刚性政策能够更有效地保护耕地,同时由于中国的快速发展,TDRs更有可能成为保护耕地的有效措施之一。由于TDRs能够区别对待不同发展阶段的地区,能够消除或减少统一的土地政策带来的效率损失,是制定和实施"因地制宜"土地政策和管理的发展方向之一。 The purpose of this study is to provide reference for land administration and development in China by analyzing the right of development system in the USA and exploring the utiliztion of economic means for changing economic interest and motivations, therefore changing the related behaviors of related persons. Methods employed in this study include institutional economics and literature quotation. After careful study, it is suggested that economic incentives based TDRs are more effective than rigid policies in conserving cultivated land. At the same time, TDRs will more probably become one of the most effective measures as China's economy develops rapidly. Because TDRs may treat regions of different economic importance differently, the loss caused by a nationwide uniform policy can be reduced or eliminated. Therefore, they are suitadle land development measures.
