摘要
经过调查研究,指出我国在医疗知情同意告知方面存在着五大问题:告知主体不明确、告知受体不明确、告知方式不明确、知情同意书文本不规范。同时指出,在知情同意权的认知上,医患双方以及司法机关都有各自的解释和局限性,司法部门在审判中缺少尺度。
Five parts of problems in medical informed consent rights in China were discovered. Main body, receptor and mode were all unclear. Informed consent document was not normal. Hospital, patient and court explained informed consent rights in different way. There was no standard in trial.
