结合新型绿色电源领域,从三方面论述了专利与技术秘密保护模式的各自利与弊。通过分析我国现行《专利法》中独占性、地域性、时间性的三大特点和《反不正当竞争法》中的优点以及存在的不足,找出专利法保护技术方案和技术秘密保护技术方案的利弊,结合我国绿色电源高新技术领域的发展,就如何把握何时用专利法律制度保护自己的技术方案、何时用技术秘密保护自己的技术方案进行了探讨。

Through the applications in the green natural power section, the advantages and the disadvantages in three aspects between the private-technological protection and patent protection to the technology were discussed. At the same time, an analysis in the three characteristics of the patent was given ,which were exclusive, regional and timing, as well as the defects in the ＂Patent Law＂ ＂Details in the implementation of Patent Law＂, used currently in China. Connecting with the development in the green natural power section in China, the time to use the legal system to protect your patent and the time to use the method of secret-technology protection to avoid your patent from invasion were discussed.
