摘要
传统行政法理论将对行政权的控制限制在外部主体上不免有失偏颇。若要促进政府与公民之间的和谐,形成互利互惠、共同发展的协调关系,需要进一步开拓行政法理论的新视野,探索以政府自身为控制主体的行政自制。行政自制是行政主体对自身违法或不当行为的自我控制,包括自我预防、自我发现、自我遏止、自我纠错等一系列下设机制,其首要的功能指向在于弥补以单纯的他制为手段的制约模式的诸多不足,完善行政权的控制机制。在基本理论上,社会学、伦理学和文化基础三个方面均能为行政自制提供支撑。重要的是,行政自制与他制之间是互补而非排斥的关系。
It' s partial to confine the domination of administrative fight to outer subjective in the traditional theory of the administrative law. Further exploring the new vision on the administrative law, researching the self restraint in administration based on the government itself helps to promote the harmony relationship be- tween the government and the citizen, thus form the coordination relationship of mutually beneficial and devel- opment. The self - restraint in administration is the self - restraint to the illegal action caused by the government itself, including a series of restraint process such as self - prevention, self - deterrence and self - correction. The primary function is to make up for the insufficiency of restraint mode, which is only based on the mode of heteronomy, therefore perfect the restraint mode for the administrative right. Basically, the self - restraint in administration could be sustained by all the three aspects outlined below: sociology, logic and the cultural foundation. Conclusively, the self restraint in administration is not incompatible with heteronomy, on the contrary they are complementary.
