本文拟从"共同福利"理念来分析高校与学生法律关系二元模式的必要性,通过对高校学生管理中平权性法律关系和隶属性法律关系的清晰界定,进而指导高校以不同的法律视角来区别对待学生管理工作中的不同问题,实现学生个人权利与社会利益的均衡发展,并最终构建出"和谐校园"的图景。

The article analyses the necessity of the dual mode of legal relation between universities and students from common good, by the clear definition for the equal legal relation and the dependent legal relation in student＇s management of universities, farther directs universities to distinctively deal with different problem in student＇s management in point of different law respect, and carry out balanced development between student＇s private fight and social benefits, finally constructs beautiful prospect of harmonious campus.
