摘要
我国物权法规定的第三人善意取得制度,是通过牺牲原所有权人利益而维护交易安全的制度安排。善意取得存在法理基础,承载了维护秩序与效率的基本法价值的要求,是民法公平原则的体现,也是物权法本身内在结构及物权公示原则的要求和必然结果。
Good faith acquisition in our country's real estate law is the system which deprives original owner's right to keep transaction security. The good faith acquisition system undertakes the mission to maintain order and improve efficiency,which is one of the basic values. The good faith acquisition system embodies fair principle of civil law. The good faith acquisition system reflects the requirement of principle of public summons and trust.
