农村集体经济组织的法律保护

Legal Protection of Rural Collective Economic Organization

我国目前的农村现实中村民委员会与集体经济组织是并存的,村民委员会的职能在于公共事务和公益事业,而集体经济组织的职能在于管理集体财产;村民委员会只在没有集体经济组织的情形下,才能担当管理集体财产的职责。就目前的立法而言,一方面,实务中的村民委员会等自治组织担当管理集体财产的职责处于不力的地位;另一方面,现行的乡镇政府充当乡镇集体经济的管理者不尽合理。由此,就必须从界定农村集体财产权的性质为按份共有以及要在集体财产权的行使方面真正体现民主管理原则等方面加强集体经济组织的立法,进而保护农村集体财产权。

At present, the village committee and the collective economic organization coexist in Chinese countryside. The villagers committee＇s function lies in the public affairs and the public welfare undertakings, while the collective economic organization＇ s function lies in the management of collective property. Only under the situation that there is no collective economic organization can the villagers committee take the responsibility of the management of collective property. Speaking of the present legislation,on one hand, the village committee is in the unfavorable condition in the management of collective property; on the other hand, it is unreasonable that the local township government play the role of manager of the collective economy. In order to protect the rural collective property rights, we must strengthen the legislation from the aspects of defining the nature of rural collective property rights and reflecting democratic management.
