On the Conflicts and Coordination Between Judicial Independence and Media Surveillance

在中国,舆论通过媒体对审判活动进行监督,是在政治、经济体制改革,包括审判体制改革的过程中被提出并不断加强和发展的。近年来,审判公开制度的大力推行以及新闻舆论监督的日趋活跃,促使审判与媒体之间的冲突趋于明显和频繁。对审判独立与媒体监督二者之间的关系及冲突的协调进行深入、系统的研究是十分必要的。

In the process of Chinese political, economic and judicial reforms, public surveillance via media over judicial activities is suggested, strengthened, and advanced. In recent years, the vigorous push in open trials and the increasingly active surveillance of public media both trigger the more conspicuous and frequent conflicts between judicature and media. Therefore, it is quite necessary to do profound and systematic researches in handling the conflicting relationship between the two sides.
