摘要 中国的弹性就业是伴随着计划经济向社会主义市场经济、农业社会向工业社会、信息社会的转型而产生与发展的。具有不同于西方市场经济国家的特征。欧盟的三方机制,在弹性就业的规范和发展中起到了至关重要的作用。目前,我国三方参与基础性劳动立法的任务仍然非常繁重。但另一方面,各种针对弹性就业的专门性的法律法规也需要三方发挥更大的作用。各级三方应该做出更大的努力和相应的调整,来应对这种立法专业化的需要。 Along with the transition from planning economy to socialist marketing economy, from an agricultural society to an industrial society and information society in China, the flexible employment appeared and expanded. The flexible employment in China has characteristics different from the developed countries. The tripartite mechanism of EU plays a very important role in administrating and developing flexible employment.At present, it is burdensome to tripartite participate in labor legislation in China.However, to implement laws of flexible employment needs tripartite mechanism play a, more important role.
