法律监督权与检察权的关系是一个宪法学、检察理论学的基本问题。基于历史解释在我国法律解释中的重要意义,本文采用历史解释方法对法律监督权与检察权之间的关系予以阐释。检察权是检察机关行使法律监督权的方式和手段。

The relationship between legal supervising rights and procuratorial rights is a basic issue of the study of Constitution and procuratorial theory. Based on the significance of historical interpretation in China＇s legal interpretation, this paper used the historical interpretation to explain the relationship between legal supervising rights and procuratorial rights. Procuratorial rights are the ways and means for the procuratorial organs to exert legal supervising rights.
