摘要
反规避措施是当前美国及欧盟对外贸易法律体系中反倾销法的新发展。反规避措施有助于消除倾销,但在另一方面被用作推行贸易保护主义的新的非关税壁垒手段。本文根据当前欧美等国反规避措施不断发展的现状,力图从反规避措施的概念、范围及规避行为的确认等角度,对这一新生法律现象进行粗浅的分析,并针对其中存在的消极的贸易保护主义倾向,结合我国的外贸实践,提出了该法律现象对我国反倾销立法的借鉴意义和对外贸易实践的警戒意义。
Anti-circumvention measures are new developments of anti-dumping law in current foreign trade legal system of the USA and EU. Anti - circumvention measures could help eliminate dumping. these measures are helpful in eliminating dumping; On the other hand, they are used as new tariff barriers to impose national trade protectionism. Based on this, the present paper has made some suggestions for anti-dumping legal system in our country.
